Mariner Mechanical Services (“we”, “us” or “our”) provides marine vessel repair, maintenance, servicing and installation services (“Services”) to customers (“you” or “your”) in Western Australia. We are committed to protecting your privacy and handling your personal information responsibly and transparently.
This Privacy Policy explains how we collect, hold, use and disclose personal information in connection with our Services and our website, and how you can access or correct your information or make a complaint. It should be read together with our Terms and Conditions for Marine Vessel Repair Services.
We handle personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs). While Mariner Mechanical Services may qualify as a small business for the purposes of the Privacy Act, we have chosen to handle personal information in line with the APPs as a matter of good practice and to give you confidence in how your information is treated.
2. What Personal Information We Collect
The personal information we collect depends on the nature of your dealings with us, and may include:
- Identity and contact details — name, address, phone number, email address.
- Vessel and service information — vessel make, model, registration/identification details, service history, condition reports, photographs of the vessel, and details of the repairs or work requested.
- Financial and payment information — billing address, payment method details, invoicing and transaction records (we do not store full credit card numbers).
- Ownership and finance information — details confirming vessel ownership, or finance, lease or hire-purchase arrangements and secured party consents, relevant to our Repairer’s Lien and Personal Property Securities Act 2009 (Cth) obligations.
- Insurance information — details of your marine insurer and policy, where a repair relates to an insurance claim.
- Communications — records of emails, phone calls, Repair Orders, Quotes and other correspondence with you.
- Website and technical information — if you use our website, we may collect standard technical data such as IP address, browser type, device information and pages visited, including via cookies (see Section 8).
3. How We Collect Personal Information
We usually collect personal information directly from you, including when you:
- Make a booking or enquiry by phone, email, in person or through our website.
- Sign a Repair Order or otherwise authorise Services.
- Provide vessel documentation, service history or payment details.
- Correspond with us regarding warranty claims, complaints or general enquiries.
We may also collect personal information from third parties where reasonably necessary, such as from your marine insurer, a finance or leasing company with an interest in the vessel, subcontractors engaged to perform specialist work, or publicly available registers (for example, the Personal Property Securities Register).
4. Why We Collect, Hold and Use Personal Information
We collect, hold and use personal information for purposes including:
- Providing quotes and carrying out repair, maintenance, servicing and installation Services.
- Verifying vessel ownership and any finance, lease or security interests, and registering or enforcing our security interest or Repairer’s Lien under the PPSA where applicable.
- Invoicing, processing payments, and recovering overdue amounts (including engaging debt collection or legal services where necessary).
- Communicating with you about bookings, Quotes, variations, warranty matters and completed work.
- Complying with our legal obligations, including under the Australian Consumer Law, the Occupational Safety and Health Act 1984 (WA), the Navigable Waters Regulations 1958 (WA), AMSA standards, and the Disposal of Uncollected Goods Act 1970 (WA).
- Managing insurance claims relating to your vessel or our Services.
- Improving our Services, workplace safety and customer experience, including responding to feedback or complaints.
- Direct marketing (for example, service reminders or promotions), where you have not opted out — see Section 7.
5. Disclosure of Personal Information
We only disclose personal information where necessary for the purposes above, or as required or authorised by law. We may disclose personal information to:
- Your marine insurer, for claims-related work or to verify cover.
- The Australian Maritime Safety Authority (AMSA) and the Department of Transport (WA), where required for licensing, safety or regulatory purposes.
- Subcontractors and specialist trades engaged to carry out or assist with Services, on a confidential basis.
- Financiers, lessors or other secured parties with a registered or disclosed interest in your vessel, where relevant to our Repairer’s Lien or PPSA security interest.
- Debt collection agencies, lawyers or courts, where necessary to recover unpaid amounts or resolve a dispute.
- Our professional advisers, insurers, and IT or software service providers who support our business operations, under confidentiality obligations.
- Government or regulatory bodies where required or authorised by law (for example, in relation to workplace safety or environmental compliance).
We do not sell your personal information to third parties. We do not currently disclose personal information to overseas recipients; if this changes (for example, through the use of an overseas-based cloud service provider), we will update this Policy accordingly.
6. Personal Property Securities Register (PPSR)
Where we register a security interest over your vessel on the Personal Property Securities Register in connection with our Repairer’s Lien, limited details relevant to that registration (such as vessel identifying information and the amount secured) may be recorded on the PPSR, which can be searched by third parties in accordance with the Personal Property Securities Act 2009 (Cth).
7. Direct Marketing
We may use your contact details to send you service reminders, seasonal maintenance tips or occasional promotional communications. You can opt out of direct marketing at any time by contacting us using the details in Section 11, or by using any unsubscribe function included in the communication. We will not use sensitive information for direct marketing purposes.
8. Our Website and Cookies
Our website may use cookies and similar technologies to help it function properly, understand how visitors use the site, and improve our services. Cookies do not identify you personally. You can adjust your browser settings to block or delete cookies, though this may affect how the website functions.
If our website includes forms, live chat, or booking tools operated by third-party service providers, those providers may separately collect information in accordance with their own privacy policies.
9. Data Security
We take reasonable steps to protect personal information we hold from misuse, interference, loss, and unauthorised access, modification or disclosure. These steps include restricting access to personal information to authorised staff, using secure systems for storing electronic records, and retaining physical records (such as Repair Orders) securely on our premises.
No method of storage or transmission is completely secure. If we become aware of a data breach likely to result in serious harm, we will comply with our obligations under the Notifiable Data Breaches scheme in Part IIIC of the Privacy Act 1988 (Cth), including notifying affected individuals and the Office of the Australian Information Commissioner (OAIC) where required.
We retain personal information only for as long as reasonably necessary for the purposes it was collected, including to meet legal, accounting, warranty or reporting requirements, after which it is securely destroyed or de-identified.
10. Access and Correction
You may request access to the personal information we hold about you, or ask us to correct it if it is inaccurate, out of date, incomplete, irrelevant or misleading. To make a request, contact us using the details in Section 11. We will respond within a reasonable time. In some circumstances we may need to verify your identity before providing access, and there may be limited situations where access can be refused (for example, where it would unreasonably impact the privacy of others) — if so, we will explain why.
